This raises an excellent point. People who ask for black henna often
essentially want a phony tattoo. People who want a phony version of
something generally have a very superficial interest in it. They are
the trend followers. And trend followers rarely stay interested for
long. Therefore, this is the market that is going to disappear when
henna is no longer trendy (and the trend is so hot right now that it's
got to burn out to some degree). All the artists who base their
business on black henna will be out of luck when this happens. All
that will be left is those nagging law suits.

When you have a black henna, you always get asked, "Is that a tattoo?"
and have to say, "No. It's fake." (shamefully) But when you wear
brown henna, people say, "Cool. Is that henna?" and you get to say,
"Yes." (proudly)

Phony things never stay hot for long - remember those fake-piercing
ear cuff things?
