Should we stiill be petitioning the FDA?

It's henna season again and I'm wondering since the FDA seems to be
getting uppity about seizing henna if it might be a good idea to do
another round of petitions. Do they keep public records of petitions
and letters? I'd like to see how many they actually got, and if
there's a recorded response to them. I know lots of other folks sent
stuff in, too.
If the decision remains unchanged, is it possible to bring this to a
court battle, this being a Constitutional issue and all? Costly,
yes, but more costly than having huge shipments seized? I don't know.
