they do it is often delayed, sometimes 2-3 weeks after the
application.

I believe it is quite easy to tell the difference between black
henna and a tattoo. A tattoo, even when fresh won't look as black
and will also seem to be under a couple of layers of skin,
whereas the black henna seems to sit more on the surface of
the skin and, because of this, is much blacker than a tattoo.
