I nearly added another bit to my post to say that I hadn't seen the
Blue Lotus site, so I couldn't really comment on the background
graphic. In the end I decided I'd said what I wanted to say, so I
left it.

But, since you've noticed, yes, if they did indeed nick the
background graphic, that would go against CR law. My post was
intended simply to point out the benefits of being absolutely certain
about your facts in this sort of situation. Failure to do so, as in
confusing the fern issue with the background graphic issue, gives the
person on the receiving end a legitimate strike-back, which muddies
the waters.
